Federal Judge Mandates Freedom of Kilmar Abrego Garcia from Immigration Detention
A court has ordered the prompt release of Kilmar Abrego Garcia from immigration custody, finding his ongoing confinement is without lawful basis.
"Since Abrego Garcia's return from wrongful detention in El Salvador, he has been taken back into custody, again without lawful authority," the judge wrote in her order.
The case stems from a erroneous removal to El Salvador earlier this year, which US authorities later admitted was an error. After his repatriation to the United States to answer human smuggling charges, he was held in immigration detention.
In her order, the judge pointed out that the authorities does not have a current deportation order, which effectively blocks them from removing Mr. Abrego Garcia "for now."
