The ex-lawyer for the former president has resigned as the US Attorney for New Jersey. This follows a judicial decision that invalidated her legal standing to hold the office.
Acceptance of Resignation
The nation's top law enforcement official, the Attorney General, confirmed her stepping down on Monday. Bondi stated that the appeals court finding made it impossible for her to perform her duties.
"Do not interpret compliance for surrender," she wrote. "The effort will now extend throughout the country."
Court Ruling
Her resignation was triggered by a federal appellate panel ruled that she had been unlawfully serving as the top prosecutor. This decision is expected to impact many prosecutions in New Jersey.
The judicial panel declared that a temporary posting that did not receive the advice and consent of the Senate breached the federal law governing appointments.
Future Role and Reaction
The Attorney General added that she will stay on at the Department of Justice as a top consultant. She will pursue additional appeals of the court's action, aiming for a reversal.
In a statement, she contended that the court "should not be able to second-guess the appointment of lawyers tasked with performing the executive branch's core responsibility of prosecuting crime."
Performance in Office
The attorney general highlighted Habba's record and said that under her leadership, the state capital of Newark saw a 20% reduction in offenses. It was also reported that the Camden experienced its first summer in 50 years without a homicide.
Legal Career
Habba, originally became part of Donald Trump's lawyers in recent years. Subsequently, she defended Trump in his hush-money trial in the previous year, leading to his conviction on multiple felony counts of falsifying business records.
Prior to her appointment to the federal prosecutor position, the former president had revealed he was naming her as his presidential counsellor in a potential future term, calling her as a steadfast ally and a dedicated fighter for justice.
